AI Liability

AI is probabilistic. We are not liable if your agent hallucinates, promises refunds, or gives incorrect advice. You are responsible for the output.

No Robocalling

Strict Acceptable Use Policy. Unsolicited marketing, spam, spoofing, and harassment are prohibited and will result in immediate bans.

Financial Responsibility

You are responsible for protecting your API keys. Any usage incurred by your credentials (even if leaked) is your financial responsibility.

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User" or "Customer") and Abdullah bin Amir Trading SPC, trading as Badal Technologies ("Provider", "we", "us"), a company registered in the Sultanate of Oman.

By accessing or using the Iqra AI platform (including app.iqra.bot, the API, and associated services), you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Account Registration and Security

  1. Eligibility: You must be at least 18 years old and capable of forming a binding contract.
  2. Credentials: You are responsible for maintaining the confidentiality of your login credentials and API Keys.
  3. Liability: You are fully responsible for all activities that occur under your account, including any financial charges incurred by the use of your API keys, even if that usage was not authorized by you (e.g., in the event of a leak on your end).

3. Usage & Billing

Iqra AI operates on a Hybrid Pricing Model (Subscription + Usage Credits).

  1. Pre-paid Credits: Usage-based features (Telephony, AI generation) require a positive Credit Balance.
  2. Deductions: Costs are calculated and deducted after a session completes.
  3. Negative Balance: If a session cost exceeds your available balance, your account will go into negative balance. You agree to pay this outstanding amount immediately. We reserve the right to suspend services until the debt is settled.
  4. No Refunds on Usage: Credits purchased and consumed for telephony or AI generation or our service are non-refundable, as these incur real-time costs from our underlying providers or our service usage.
  5. Sub-Processor Costs: You acknowledge that Iqra AI acts as an orchestrator. We pass through costs from providers like Twilio, OpenAI, and ElevenLabs if applicable. Rate changes from these providers may be reflected in our pricing with notice.

4. Acceptable Use Policy (AUP)

You agree NOT to use the Service for any unlawful, harmful, or ethically prohibited purpose.

You are solely responsible for complying with all applicable laws regarding telephone communications, including but not limited to:

4.2 Ethical & Political Restrictions (Restricted Persons)

Consistent with our Open Source Software License, Badal Technologies strictly prohibits the use of the SaaS Service by specific entities and individuals based on defined ethical and moral grounds.

You represent and warrant that you are NOT:

  • A citizen, resident, or entity of Israel.
  • An individual or entity claiming to be Israeli.
  • An individual or entity publicly or privately supporting, funding, or promoting the state of Israel or its military actions.
  • An individual or entity publicly or privately supporting, funding, or promoting the genocide or violence against Palestinians or other Muslim populations/nations.
  • An individual or entity publicly or privately promoting anti-Islamic sentiments or acting against the interests of Muslim populations.

ENFORCEMENT: We reserve the right to perform background checks. If we determine, at our sole discretion, that you fall into any of these categories, your account will be terminated immediately without notice and without refund, and you will be permanently banned from the platform.

You may not use the Service to:

Badal Technologies assumes NO LIABILITY for harms caused by your violation of this AUP. We reserve the right to:

  1. Immediately terminate your account.
  2. Report your activities and identity to relevant law enforcement authorities.
  3. Take legal action against you for damages caused to the platform's reputation.

5. Intellectual Property

  1. Our IP: Badal Technologies retains all rights, title, and interest in the Iqra AI Platform, its code, design, and infrastructure.
  2. Your IP: You retain full ownership of your User Content (Scripts, Prompts, Knowledge Base).
  3. License to Host: You grant us a limited license to host, process, and execute your User Content solely for the purpose of providing the Service to you.

6. AI Disclaimer & Limitation of Liability

The "Hallucination" Clause

1. Probabilistic Nature: You acknowledge that Artificial Intelligence (LLMs) is probabilistic and non-deterministic. The Service may generate Output that is inaccurate, offensive, or factually incorrect ("Hallucinations").

2. No Reliability: You should not rely on the Service for critical advice (medical, legal, financial) without human verification.

3. Waiver: Badal Technologies is not liable for any damages, losses, or legal consequences arising from inaccurate statements made by your AI Agent, promises made by the AI Agent, or misinterpretation of user intent.

Infrastructure: We do not guarantee 100% uptime. We are not liable for outages caused by third-party sub-processors (e.g., if OpenAI goes down, or if Twilio fails to route a call).

Maximum Liability: To the maximum extent permitted by law, our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the three (3) months preceding the incident.

7. Third-Party Integrations

The Service allows you to connect third-party accounts (e.g., Twilio, HubSpot, Google).

  1. By connecting an integration, you authorize us to send your data to that third party.
  2. We are not responsible for the data practices, security, or uptime of these third parties.
  3. Your relationship with those providers is governed by their respective agreements.

8. Termination

  1. By You: You may stop using the Service at any time.
  2. By Us: We may suspend or terminate your access immediately if you violate these Terms, the Acceptable Use Policy, or if required by law.
  3. Data: Upon termination, we may delete your data after a standard retention period (30 days) as outlined in our Privacy Policy.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Sultanate of Oman. Any dispute arising from these Terms shall be resolved exclusively in the courts of Oman.
